StudyBuddy Terms of Service
Effective date: July 7, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Carlos Lopez ("StudyBuddy", "we", "us") governing your use of studybuddy.vc and any related applications (the "Service"). By creating an account, starting a guest session, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements.
2. The Service
StudyBuddy transforms study material you provide (documents, text, and YouTube videos) into practice questions, flashcards, explanations and study analytics, using artificial intelligence, and directs your practice based on your performance.
AI generated content. The study materials the Service produces are generated by artificial intelligence models. AI generated content can be inaccurate, incomplete or misleading. You are responsible for verifying any information that matters to you against your original sources. The Service is a study aid; it is not a source of professional, medical, legal or academic truth, and it does not replace your course materials or instructors.
No outcome guarantees. StudyBuddy does not guarantee any academic or professional outcome, including passing any exam, obtaining any grade, or achieving any certification. Progress indicators, scores and readiness signals shown in the Service are estimates based on your activity within the Service and must not be relied on as predictions of real world results.
3. Accounts and guest sessions
- You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
- Guest sessions are temporary. A guest session and all of its data (documents, questions, flashcards, progress) are automatically and permanently deleted approximately 24 hours after creation unless you convert the session into a full account. We are not responsible for data lost when a guest session expires.
- One account per person. Accounts are personal and may not be shared, sold or transferred.
4. Your content
- Ownership. You retain all rights you hold in the documents and other content you upload ("Your Content"). Study materials generated from Your Content are for your personal use as part of the Service.
- License to us. You grant StudyBuddy a worldwide, non exclusive license to host, store, reproduce, process and transmit Your Content, including to the third party AI and infrastructure providers described in our Privacy Policy, solely to operate, provide, secure and improve the Service. This license ends when you delete Your Content or your account, except for copies we must retain by law and fraud prevention records described in the Privacy Policy.
- Your responsibility for rights. You represent and warrant that you have all rights necessary to upload and process Your Content, and that Your Content does not infringe the intellectual property, privacy or other rights of any third party, and does not violate any law or any agreement that binds you (including the terms of the sources your materials come from). StudyBuddy does not monitor the content users upload and is not responsible for it. If we receive a credible claim that content infringes third party rights, we may remove it and, in case of repeated infringement, suspend or terminate the account. Reports: support@studybuddy.vc.
5. Acceptable use
You agree not to:
- Circumvent, or attempt to circumvent, usage limits, credit limits, plan limits, device fingerprint controls or any technical protection of the Service, including by creating multiple accounts, deleting and recreating accounts, or manipulating guest sessions to obtain additional free usage;
- Resell, sublicense or commercially exploit the Service or the materials it generates without our written consent;
- Use automated means (bots, scrapers, scripts) to access the Service, or place unreasonable load on our infrastructure;
- Reverse engineer, decompile or attempt to extract the source code, models, prompts or algorithms of the Service;
- Upload content that is unlawful, malicious (including malware), or that you do not have the right to use;
- Use the Service to build or train a competing product;
- Interfere with other users' use of the Service or with its security features.
We may suspend or terminate accounts that violate this section, without refund of amounts already consumed.
6. Plans, credits and billing
- Credits. Processing study material consumes credits. Credit costs depend on the size and type of the material, as described in the Service. Consumed credits are not refundable.
- Monthly credits included in your plan reset on each cycle and do not accumulate or carry over. Credit packs purchased separately remain available until used, while your account exists.
- Current plans, prices and limits (credits, active documents, features) are those described on our pricing page at the time of purchase. We may change plans, prices and limits going forward; changes to a paid subscription price will be notified before they apply to your next renewal.
- Subscriptions renew automatically each billing period (monthly or annual) until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep your plan benefits until then. Except where required by law, payments already made are not refunded for partial periods.
- Downgrades and limits. If your plan changes to one with lower limits, documents exceeding the new limit are locked (not deleted) and become available again if you return to a plan that covers them. You can also delete documents to fit within your limits.
- Taxes and currency. Prices may be shown and charged in USD or, where available, in your local currency. Applicable taxes may be added where required.
- Failed payments. If a renewal payment fails, we may retry it and, if it continues to fail, downgrade the account to the free plan.
7. Refunds
Our refund policy is as follows:
- Subscription renewals. If your subscription renews and you did not intend to continue, we will refund that renewal payment provided that: (a) you request it at support@studybuddy.vc within 7 days after the renewal charge, and (b) no credits from the new billing period have been used. Once any credit of the new period has been consumed, or once 7 days have passed, the renewal payment is final.
- First time purchases and credit packs are final and non refundable, except as provided in this section or where applicable law provides otherwise.
- Service errors. When a document fails to process due to an error of the Service, the corresponding credits are returned to your account automatically. If you believe you were charged in error, or that a technical failure on our side prevented you from receiving what you paid for, contact support@studybuddy.vc and we will review your case in good faith.
- Approved refunds are issued to the original payment method.
Statutory rights. Nothing in this section limits rights that the laws of your country grant you and that cannot be waived. In particular, if you are a consumer in the European Economic Area or the United Kingdom, you may have a 14 day right of withdrawal for your initial purchase. By purchasing, you expressly request that the Service be made available to you immediately, and you acknowledge that if you withdraw after having used the Service, the refund may be reduced in proportion to the use already made (for example, credits already consumed), and that the right of withdrawal does not apply to renewals of an existing subscription except where the law provides otherwise.
8. Intellectual property
The Service, including its software, design, brand, and all content we provide (other than Your Content), is owned by StudyBuddy or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non exclusive, non transferable, revocable license to use the Service for your personal, non commercial study while you comply with these Terms. No other rights are granted.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE OR SECURE; (b) AI GENERATED MATERIALS WILL BE ACCURATE, COMPLETE OR SUITABLE FOR ANY PARTICULAR EXAM OR PURPOSE; OR (c) ANY PROGRESS OR READINESS INDICATOR REFLECTS YOUR REAL WORLD PREPARATION. YOU USE THE SERVICE AND ITS OUTPUTS AT YOUR OWN RISK.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) STUDYBUDDY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL OR ACADEMIC OR PROFESSIONAL OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY; AND (b) STUDYBUDDY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) 50 USD.
Nothing in these Terms limits liability that cannot be limited by law, including liability arising from our willful misconduct.
11. Indemnification
You agree to indemnify and hold harmless StudyBuddy and its operator from any claim, demand, damage or expense (including reasonable attorneys' fees) arising from: (a) Your Content, including any claim that it infringes third party rights; (b) your violation of these Terms; or (c) your misuse of the Service.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give reasonable notice where feasible). Upon account deletion, your data is removed as described in the Privacy Policy. Sections that by their nature should survive (including 4, 9, 10, 11 and 14) survive termination.
13. Changes to the Service and to these Terms
The Service evolves continuously; we may add, modify or remove features at any time. We may also update these Terms. Non material changes take effect upon posting, with the effective date updated. If we make material changes (such as changes to pricing terms, refunds or your rights), we will notify you through the Service or by email before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of Mexico. Any dispute arising from these Terms or the Service will be submitted to the competent courts of Mexico City, Mexico, and the parties waive any other jurisdiction that may correspond to them by reason of their present or future domicile. Nothing in this section deprives you of mandatory consumer protections of the country where you reside.
15. Miscellaneous
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages or failures of infrastructure, hosting, AI or payment providers, network failures, acts of authority, or force majeure events.
- If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
- These Terms and the Privacy Policy are the entire agreement between you and StudyBuddy regarding the Service.
- You may not assign these Terms; we may assign them as part of a business transfer.
- Our failure to enforce a provision is not a waiver of it.
